Eviction Forms Criteria for Landlords

In the fall of 2024, the Arizona Department of Child Safety (DCS) mailed letters to parents who once had an open dependency and/or severance case.

Prior to filing an eviction complaint you will need the following:

  • Be aware that eviction filings move quickly through the court system
  • Dates and methods of notices
    • YOU CANNOT FILE AN EVICTION COMPLAINT WITHOUT FIRST GIVING AN APPROPRIATE AMOUNT OF NOTICE TO THE TENANT
  • Names, address, and phone numbers of each tenant
  • Non-Payment of Rent
    • Amount of rent due
    • Attorney fees owed (if applicable)
  • Other causes for eviction
    • Dates/locations/circumstances involved
  • Itemized cost of repairs caused by the tenant
  • File at the correct court location
    • If the amount owed by the tenant exceeds $10,000, filing occurs at Superior Court
  • Pay the correct filing fee

Amount of notice required based on eviction type:

  • Non-Payment of Rent - 5 Days
  • Material noncompliance with rental agreement - 10 Days
  • Material noncompliance materially affecting health and safety - 5 Days
  • Immediate and Irreparable Notice - Same Day Filing is Allowed
  • Mobile Home Park Eviction Information

Types of acceptable service:

  • Hand delivery
  • Certified mail
  • Process server
