Who is a related person or has a legal interest?

The following are examples of those who are related or have a legal interest in an informal probate matter:

  • A surviving spouse
  • An adult child, parent, brother, or sister
  • An heir of the decedent
  • A person named to serve as personal representative in the will
  • A personal representative or executor appointed in the state of residence, or a person named by the personal representative from the state
  • Any creditor of the decedent (if it has been 45 days or more since the death)
  • The office of the County Public Fiduciary
