FAQ - Civil Cases in Superior Court

In the fall of 2024, the Arizona Department of Child Safety (DCS) mailed letters to parents who once had an open dependency and/or severance case.

What is a waiver of service?

A person to an action may also sign an acceptance also known as a waiver of service; waiving service saves costs and gives the person answering 60 to respond to the complaint instead of 20.  To waive service the defendant, the person who would have been served, issuing a waiver in writing, signing and filing it with the court. More information about the specific requirements can be found in Arizona Rules of Civil Procedure Rule 4(f) and 4.1(c).
