What is the difference between a trial and an oral argument for an appeal?
An oral argument is an opportunity to discuss why the decision of the trial court was incorrect. No new evidence is presented. The only evidence consists of the papers, exhibits, and testimony previously admitted by the Superior Court. The Court of Appeals and Supreme Court do not conduct trials.
