Can You Appeal?
Before filing an appeal, know whether or not your case qualifies and receive a final order, sentence, or judgment from the court.
If you entered a plea of guilty, responsible, or no contest, you cannot appeal.
There are 3 things you can appeal:
- a guilty verdict after your trial or submittal
- an order denying a motion for new trial or an order affecting your substantial rights
- an illegal or excessive sentence
For cases in traffic court, you will be provided a written notice of the right to appeal. This notice contains the time limit for the appeal, instructions for filing, and where you can find the rules associated with the appeal.
